It ain't burglary if the owner says OK

Eight men were caught stripping a million-dollar Loxahatchee Groves home that was being foreclosed, but a judge has decided they weren’t doing anything illegal, PalmBeachPost.com reports. Even though the property might really belong to the bank, it technically still belongs to a guy who told the men to go ahead and take everything.

The men — who were removing appliances, cabinets, toilets, tiles and even copper wire — had been charged with burglary of an unoccupied dwelling, criminal mischief, grand larceny and possession of burglary tools.

Assistant Public Defender Marie Calla said, “It may be immoral and unethical, but it’s not a crime if you own the property.”

Judge Ted S. Booras noted that “banks have legal remedies that they’re not exercising, such as getting restraining orders. There (are) some serious civil issues between everybody and the bank, (but) they’re civil, not criminal.”
