Bush removes Miami city commissioner

Gov. Jeb Bush issued an executive order this afternoon suspending Miami City Commissioner Johnny Lee Winton from office after Winton was charged with two felony counts of battery on a police officer
stemming from a May altercation at Miami International Airport. Winton, also charged with disorderly intoxication, allegedly got into a fight with police after his flight was canceled. See the executive order in comments.

    Executive Order of Suspension)

    WHEREAS, Johnny Lee Winton is presently serving as a City Commissioner for the City of Miami, Florida; and
    WHEREAS, on June 16, 2006, an information was filed charging Johnny Lee Winton with two counts of battery on a police officer and disorderly intoxication, violation of Sections 784.03(1), 784.07(2)(b) and 856.011(1), Florida Statutes, respectively; and

    WHEREAS , violation of Section 784.03(1), Florida Statutes, constitutes a misdemeanor of the first degree; violation of Section 784.07(2)(b), Florida Statutes, constitutes a felony of the third degree; and violation of Section 856.011(1), Florida Statutes, constitutes a misdemeanor of the second degree; and

    WHEREAS, it is in the best interests of the residents of the City of Miami, and the citizens of the State of Florida, that Johnny Lee Winton be immediately suspended from the public office, that he now holds, upon the grounds hereinafter set forth;

    NOW, THEREFORE, I, JEB BUSH, Governor of Florida, pursuant to the Constitution and the laws of the State of Florida, do hereby find, determine, and for the purposes of Article IV, Section 7 of the Florida Constitution and Section 112.51, Florida Statutes, allege as follows:

    A. Johnny Lee Winton is, and at all times material hereto was, City Commissioner for the City of Miami, Florida.
    B. The office of the Miami City Commission is within the purview of the suspension powers of the Governor, pursuant to Article IV, Section 7, of the Florida Constitution and Section 112.51, Florida Statutes. The attached information alleges that Johnny Lee Winton, committed acts in violation of the Laws of Florida and this information is hereby incorporated as if fully set forth in this executive order.

    C. This suspension is predicated upon the attached information, which alleges the commission of two acts punishable as felonies.

    BEING FULLY ADVISED in the premises, and in accordance with the Constitution and the laws of the State of Florida, this Executive Order is hereby promulgated, effective immediately:

    Section 1. Johnny Lee Winton is hereby suspended from the public office, which he now holds, to wit: City Commissioner for the City of Miami, Florida.

    Section 2. Johnny Lee Winton is hereby prohibited from performing any official act, duty, or function of public office; from receiving any pay or allowance; and from being entitled to any of the emoluments or privileges of public office during the period of this suspension, which period shall be from the effective date hereof, until a further Executive Order is issued, or as otherwise provided by law.

    IN TESTIMONY WHEREOF, I have hereunto set my hand and have caused the Great Seal of the State of Florida to be affixed at Tallahassee, the Capitol, this 20th day of June, 2006.

    Good. Too bad Cynthia McKinney got away with assualting a police officer. Guess you have to be a member of Congress for that privilege.

    Gov. Bush won't allow that in our great state. Go Jeb!!!

    The Miami City Charter allows the remaining council members to appoint a qualified voter to fill the vacancy within 10 days or call for a special election. The council will likely pick a temporary replacement pending an election in November to fill the unexpired term.
    And Winton, to his credit after striking a police officer, will plead "not guilty" in a court of law, but not plead "victim" in the court of public opinion. Some elected officials still have a sense of shame over their bad behavior.

    I'm pretty sure it's a "commission" not a "counsel".

    You should know better than that.
