Is the Ben Gamla charter school unconstitutional?

The Ben Gamla charter school touts itself as a Hebrew-English charter school that also focuses on Hebrew culture. Started in Broward County, it is expanding in the fall into Pinellas and Palm Beach counties.

Rabbi Bruce Warshal suggests in a column for Florida Jewish Journal that the school threatens both Judaism and the Constitution.

"If the Ben Gamla schools are constitutional, what would stop the Catholic Church or the evangelical movement from establishing charter schools based on the study of Western Culture? We know that an integral part of that culture is the rise of Christianity. I do not want to pay for the study of their religion any more than they want to pay for Jewish kids studying Judaism under the guise of Hebrew language study.

Where is the ACLU when we need them? When will some good taxpayer step up and challenge this fraud? These schools are bad for Judaism and bad for America."

Haven't heard much of this conversation here in the Tampa Bay area. Your thoughts?
