Gabriel Aubry says Halle Berry's fiance Olivier Martinez started fight

The Halle Berry family drama sideshow continues, as baby daddy Gabriel Aubry has gone to court to fight for custody of their daughter Nahla following that Thanksgiving Day fistfight with Berry's fiance, Olivier Martinez. Gabriel is alleging it was Olivier who started the fight, contradicting earlier reports that Aubry pushed him. Meanwhile, let's all gawk at that post-fight photo police took when Gabe got arrested. Yeesh.

According to People, Aubry says that Martinez approached him during dropoff Thursday morning, when Olivier brought up Aubry's recent court battle with Berry over whether she could move their 4 1/2-year-old daughter to France. "You cost us $3 million," Martinez allegedly said, according to Aubry. "When you see the judge, you're going to tell him you're going to Paris or I'm going to kill you."

Aubry claimed in a request for a restraining order against Martinez that upon arrival, Nahla said, "Olivier is here. I'm scared." He further details that after confronting Aubry, Martinez started the fight.

"All of a sudden, Mr. Martinez jumped me on the side of my body, and punched me such that he had taken me down to the ground," Aubry said. "He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete driveway. It all happened so fast and so suddenly; I did not see Mr. Martinez's actions coming, and thus, I was not ready for it and was not able to defend myself."

Gabriel further claims Martinez said, "From now on you're going to do drop offs on the street. I'm not just some f---ing actor, you don't know me." We know Martinez was a former boxer, and that he apparently doesn't like Gabriel very much. Aubry said he suffered "a fractured rib, multiple bruises on my face and my forehead, an area under my left eye, and three areas in my mouth required stitches."

The judge granted Aubry his restraining order, which matches the emergency order Berry had placed on Aubry after he was arrested Thursday. Now they all have to stay away from each other for awhile. That's probably for the best.
