Lindsay Lohan in rehab, will ask judge to stay there




While we were busy ignoring Lindsay Lohan Tuesday so we could safely lock ourselves in our zombie bunker at stately Juice* Manor, her legal team decided to head off Judge Elden Fox at the pass and send LiLo back to rehab for a fifth time (although if you ask mom Dina, this will only be the third time). And boy, it's such a trying time for our favorite head case!

"Lindsay is still being assessed by her treatment team but the team is saying that she should spend at least 45 days getting in-patient treatment," a source told RadarOnline, noting her handlers think she should remain in treatment instead of heading to jail, which is what she's probably going to get at her court hearing next month. "It's going to take her body at least 30 days to get the substances out of her system." Those must be the same substances she swore to Vanity Fair she never took. Anyway, now all we can do is wait until her Oct. 22 court date.

"Lindsay is required to be at the hearing. She will be there. She will be escorted by at least one person from the rehab facility to make sure she doesn't stray," the source said. "It's likely that a member of Lindsay's treatment team will also be called to testify. At that point, if Lindsay is making improvements, Lindsay's team would ask Judge Fox to not put her in jail at all, or defer her sentence until she is finished with her in-patient treatment."

Of course! Why should Lohan possibly go back to jail? She's only been warned a half-dozen times that's where she's going to go for breaking her probation. But leave it to this mystery source to affirm what we all already know: "The fact is jail doesn't scare Lindsay. Before she did her time earlier this summer, she was petrified. Having spent time behind bars, it doesn't have that effect on her. Jail isn't a deterrent for her, period."

Well, then she won't mind going back for a year or two. We'll help her pack her orange jumpsuit.
