Brenda Monk makes her appeal in Florida State academic misconduct case
The attorney for Brenda Monk, one of the central figures involved in Florida State's academic misconduct scandal, said the NCAA Division I Infractions Appeals Committee was "very professional, very gracious'' during Monday morning's hearing in Indianapolis.
"We made points; I just don't know how many,'' said Brant Hargrove, a Tallahassee-based attorney.
Monk, a Ph.D. and former learning specialist in the school's Athletics Academic Support Services office, has denied she committed fraud and is looking for this five-member group to overturn the findings she did and the resulting sanctions. Monk has consistently said she made a "mistake'' asking one student-athlete, a men's basketball player, to input answers on an online quiz for a teammate. (That was the incident that led to the discovery there were problems with an online music class, something Monk tried to warn her boss about.)
"We just don't think there's enough to find she committed fraud,'' Hargrove said.
Monk has sued FSU for defamation and is seeking at least $600,000 in damages.
Hargrove said he actually was given more than his allotted time of 45 minutes to make his case; he almost twice that time, thanks in part to the attorney representing the Committee on Infractions giving up some of his time.
Both he and Monk fielded some questions from the appellate committee, including about the number of learning disabled students she worked with at FSU, a number that had increased annually to about 60 by the time she resigned in the summer of 2007.
The Infractions Appeals Committee, which heard Florida State's appeal of the vacating of wins penalty on Sunday morning, typically takes more than a month to decide a case. With the holidays, it may not finish its report on Monk -- and FSU -- until early 2010.
