Allen's 'stocky black guy' comment thrown out

The solicitation case against Rep. Bob Allen may have gotten a bit tougher.

Prosecutors today said they would not rely on comments the Merritt Island Republican made to a police officer because Allen was not advised of his rights. Among other things, Allen said he offered to perform oral sex because he was afraid of of a "stocky black guy" at a Titusville park.

But Brevard County Judge Oscar Hotusing let the charge stand, setting the stage for a trial on Sept. 19. For more detail, see story in Florida Today.
