Calder files lawsuit challenging slot machines at Hialeah

Churchill Downs, owner of Calder Racetrack, today filed a lawsuit challenging the constitutionality of the recently enacted gambling law that allows for slot machines at Hialeah racetrack. The argument: the Constitution says that once the slots amendment was ratified, only existing licensed parimutuels operating the two years prior are authorized to be slot machine licensees. Their argument is that those two years were 2002-03, and Hialeah was not an operating parimutuel then.
 
The language first appeared in the proposed compact passed by the legislature late in the 2009 session. Obviously, Churchil Downs did not raise a stink about this for more than a year -- evidently so they could file this lawsuit. Download Churchill lawsuit 2010 1763_0001[1]
