High speed rail suit moving fast
The Supreme Court has issued an ordered requiring Gov. Rick Scott to respond by noon tomorrow to a lawsuit over his decision to kill high speed-rail. The plaintiff's then have until 4 p.m. to reply to his response.
Sen. Thad Altman, a Republican from Rockledge, and Arthenia Joyner, a Democrat from Tampa, filed the suit today, saying Scott exceeded his executive authority by rejecting $2.4 billion in federal money to build the line between Tampa and Orlando. They argue that Scott is effectively attempting a line-item veto of a law and appropriations approved by a previous Legislature and governor. In addition, they say he is attempting to control appropriations, which the Constitution assigns to the Legislature.
"This is not a monarchy. He is not a king," Joyner said in a news conference after the suit was filed.
