Issue polling is legal after all
A month ago, the Division of Elections stunned much of the political world with an advisory opinion that interpreted state law to prevent political committees from paying for issue polls (the practice has been ongoing for many years).
Upon reflection, Secretary of State Kurt Browning ordered the Aug. 20 opinion rescinded. A new opinion issued to the Florida Red and Blue Committee, a group opposed to a same-sex marriage initiative, says committees CAN pay for issue polls. Browning said he considered it a matter of free speech to allow committees to do issue polling. The opinion is here.
