Widow of anthrax victim can sue the feds

The Florida Supreme Court ruled 4-1 today that Maureen Stevens, whose husband, Robert, died in 2001 of anthrax exposure, can sue the federal government for failing to secure biological weapons. The case is a long way from conclusion, and a jury could still decide that the federal government wasn't negligent. But it could be precedent-setting in allowing similar cases to go forward.

Justice Harry Anstead, Chief Justice Peggy Quince and Justices Barbara Pariente and Fred Lewis agreed. Justice Charles Wells dissented. New Justices Charles Canady and Ricky Polston did not participate. Read the opinion here.
