Investigation is ongoing into Jameis Winston assault complaint

TALLAHASSEE _ Florida State University quarterback Jameis Winston is under investigation for sexual assault on a woman in a Tallahassee apartment last year, the university and law enforcement sources said Wednesday. 

State Attorney Willie Meggs would not confirm that the investigation is of Winston but said an 11-month-old complaint was turned over to the Leon County state attorney on Wednesday after media inquiries were made to the Tallahassee Police Department. The complaint was first reported by the online web site TMZ.
 
Police released a copy of the incident report but redacted the name of the alleged victim and listed the perpetrator as "unknown unknown." Sources confirmed Winston is the subject of the report.
 
According to the report, Winston is accused of using physical force to assault an individual over the age of 18 on Dec. 7, 2012, at an apartment in Tallahassee.  Download HTE 12-32758
 
Winston, a frontrunner for the Heisman Trophy, could not be reached for comment. His lawyer, Tallahassee attorney Tim Jansen said on Wednesday that no charges have been filed, the case was closed in February and Winston has denied the allegations.

“We are cooperating with the investigation,''Jansen told the Herald/Times. "The case was closed n February and we don't know why it was reopened. We are cooperating with investigators and we hope it will be resolved quickly in favor of Mr. Winston."

Police were called at 4:01 a.m., according to the report. Photos were taken of the alleged victim's injuries and physical evidence was collected.
 
Winston was described in the report as "muscular" and the motive for the incident was "sexual gratification." The victim had been drinking before the incident. Winston wore a red t-shirt and jeans and was described as "polite." 
 
Officials with the Tallahassee Police Department did not return calls from the Herald/Times for a request for comment. A statement released by Officer David Northway, spokesman for the TPD, said the investigation is ongoing and the victim is cooperating with the state attorney.
 
Meggs told the Herald/Times he did not  know why it took 11 months for for the police to ask his agency to get involved in the investigation. 
 
"I don't have the answer to that,'' Meggs told the Herald/Times. "You'll have to contact the police department."
 
Jansen said Winston has not been interviewed by police or prosecutors.

The FSU athletic department said in a statement: “We are aware of a matter that was investigated by the Tallahassee Police Department almost a year ago. Because the investigation has not been closed by TPD, we cannot comment further at this time. We look forward to a speedy resolution of the issue. There is no change in Jameis Winston’s status. Coach Jimbo Fisher and Jameis will be answering questions about football only until there is a resolution.”

Winston, a freshman who has led Florida State to a 9-0 record, is on FSU records as 6-4 and 235 pounds. The police report says the alleged perpetrator is between 5-9 and 5-11 and is about 240 pounds.

Winston has thrown for 2,661 yards, 26 touchdowns and seven interceptions.
