Residents continue battle against RaceTrac

BRANDON — As the battle rages over proposed big-box development in Valrico, neighbors in Brandon are entangled in a property battle of their own against RaceTrac.

Citizens filed a lawsuit against Hillsborough County and the gas station and convenience-store chain after it gained approval from the Hillsborough County Commission to develop a 40-acre wetland conservation area that was previously preserved under a 2002 rezoning act.

The plaintiffs — Oak Park Townhomes Homeowners' Association Inc., Mark Harris and Tammy C. Cabrera of Brandon — are concerned the development would compromise the area's functions as a base for wildlife, stormwater runoff and aquifer recharging.

Nearby homeowners are challenging the county's rezoning decision, claiming they were denied the opportunity to testify at a December 2012 hearing and that the county made illegal procedural decisions during the process.

The suit was filed May 9 and remains unresolved.
