Seroquel side effects case dismissed by Delaware judge

AstraZeneca, the maker of Seroquel, scored a victory in its legal battle against patients who claim the popular antipsychotic caused diabetes, weight gain and other health problems. On Tuesday, a judge in Delaware state court dismissed the first case scheduled to go to trial in that state. In January, a federal judge in Orlando dismissed two similar Florida lawsuits, a decision that is now being appealed. A spokesman for AstraZeneca said the dismissals show the evidence does not support patients' claims and reiterated the company's intention to litigate the nearly 10,000 Seroquel claims pending. Plaintiffs' lawyers have noted that early losses in both Vioxx and tobacco liability complaints did not prevent eventual multi-billion-dollar settlements.
