Some local contractors haven't been paid for work at Tampa Premium Outlets

Nearly two months after Tampa Premium Outlets opened to the public in Pasco County, some local contractors who helped build the mall say they still haven't been paid.

Pasco County public records show that four building liens have been filed against the outlet shopping center in Lutz that opened Oct. 29, and only one of those has been paid, according to the subcontractors.

Among those who filed liens is Sue Mignoli, co-owner of RoofUSA LLC, a roofing company based in Brooksville. In the lien, Mignoli states that the general contractor behind the project, VCC LLC, still owes the company $1.89 million for the $4.15 million metal roofing job the company completed. Mignoli said they haven't received a payment for their work since May.

"Simon is a big, prominent company, and we've never worked with VCC before," so Mignoli said she was surprised by the delays in payment. "We finished the work and are now waiting to get paid," she said.

Will Rushing with VCC's Tampa office said RoofUSA defaulted on its contract when it did not complete the work outlined in the paperwork. Both companies have since hired attorneys.

VCC, from Little Rock, Ark., builds shopping centers and other retail properties around the country and has built other Simon Property Group centers and other outlet malls. The company has offices across the country, including one in Tampa. Rushing said payments are made monthly to the subcontractors who worked on the project, and that each contract has its own payment schedule.

Simon Property Group did not return requests for comment.

Another subcontractor, Bill Sumansky, principal with K.N. Edwards Sales Inc. in Clearwater, has yet to be paid for $76,000 worth of work building a shade structure over the playground area at the outlet mall. Edwards Sales completed the metal fabrication work a few days before the mall's opening date.

"When you're working, it's all, 'Hurry up, we needed this yesterday.' So, we dropped everything to get this done in time," Sumansky said. "Now, it's two weeks from Christmas, and I can't pay my guys because the contractor is telling us they haven't been paid."

Sumansky plans to file a lien if his company isn't paid soon.

Liens filed to date include one by National Waterproofing Supply in Miami for a $22,977 contract with Above All Caulking & Waterproofing Inc. Diane Witt, a credit manager with National Waterproofing Supply, confirmed that $9,118 remains unpaid. A total of $2,758.52 is still owed to a contract through Marjam Supply Company through a contract with Vasquez Drywall Inc. for labor services, according to another lien.

Joe Pullaro Inc., a Tampa painting company owned by Pullaro and his wife, Berta, filed a lien for $6,100 in November but was paid about a month later, Berta Pullaro confirmed.

"We immediately covered ourselves by filing the lien," she said. "The contractor (which was Eclipse Building Corp., not VCC,) kept giving me the runaround, so I didn't want to take a chance."

Rodney Owen, owner of Seco South in Largo, built the stainless steel cages around the outlet mall's fire pits. His company had been partially paid so far for the work, but he wasn't too worried about when he would be paid in full. He hasn't filed a lien.

"This is pretty typical with a job like this," Owen said. "It can be anywhere between 30 to 60 days to see that first payment."
