Appeals court refuses to remove judge from baby-throwing case

TAMPA — An appellate panel denied on Tuesday first-degree murder defendant Richard McTear Jr.'s request to boot Hillsborough Circuit Judge Gregory Holder from his case.

The 2nd District Court of Appeal judges gave no explanation for their decision.

Last week, McTear's public defenders sought to get Holder removed from the case, claiming the judge had shown a lack of compassion and a bias against a 22-year-old defendant who faces the death penalty if convicted.

McTear is accused of attacking his former girlfriend, 17-year-old Jasmine Bedwell, and her 3-month-old son on May 5. Authorities say McTear threw the baby onto concrete, drove off with him and threw him from a car window onto Interstate 275.
