Supreme Court again upholds death sentence in 1984 Hillsborough murder

For the second time, the Florida Supreme Court on Thursday upheld a death sentence for Kenneth Allen Stewart, who was convicted in the 1984 shooting death of a Hillsborough County man.

The court found against Stewart's claims, which included that he had inadequate legal representation and that Florida's execution by lethal injection was unconstitutional. The court rejected a different appeal from Stewart in 2003.

Stewart had met Ruben Diaz at a Hillsborough County bar in December 1984 and persuaded Diaz to give him a ride. Once inside the car, Stewart pulled out a gun and forced Diaz to drive to a wooded area near Lutz, where Stewart robbed Diaz and shot him twice in the head.
