Trinity bartender fired for laughing

TRINITY — It was Saturday night, and bar manager Darra Kollios was bantering good naturedly with a customer at the Trinity Grill.

"I can't remember what we were laughing at," she said. "I think we were talking about the horse race."

All of a sudden, owner Dohaeng Heo walked up and told her to quit laughing. Minutes later, Kollios found herself without a job.

Everyone agrees on that much but little else. And no one's laughing anymore.

"I was just blown away," said Kollios, who owns an online decorative pottery business but has spent years working as a bartender to supplement her income. For the past couple of months, she has worked nights at the Trinity Grill, which has an open kitchen and plays soft rock over the radio.

Here's her version of what happened that night:

Kollios was talking with the customer when Heo walked up.

"He said 'You cannot laugh. If you laugh again you will have to leave.' "

When she asked what the problem was, he called his restaurant "a quiet place" and said she could finish her shift and go home.

"Are you firing me?"

Silence.

"Are you firing me?"

"Yes," he said.

Kollios packed up her things. The customer, whose first name was Jeff but whose last name she didn't get, helped her carry them out to the car.

Here's what Heo said happened:

Since she started working there, Kollios laughed loudly and often. She also sometimes sang to herself.

"I can't mimic it," he said of Kollios' laugh, which she describes as "more of a giggle."

He feared the noise would disturb customers, 85 percent of whom are older than 60. He said there is no ban on laughter, and he understands the higher noise level from the occasional birthday party. But he prefers a calm atmosphere.

"This is not a sports bar," he said.

On Saturday, no one complained, but Heo worried about the noise level. He asked Kollios to stop laughing and told her if she couldn't she would have to go home. Her response was "Oh, are you firing me?"

Then, she gathered up "all her private stuff" and left.

"She could still work if she wanted to stay silent," he said. Heo also said Kollios reacted angrily when he cut her hours recently because business had slowed.

"She said, 'If you try to fire me, you'll be sorry,' " he said.

Kollios called that assertion "a flat out lie."

Three days later, Kollios asked Heo for a letter documenting her status.

He obliged.

"WHENEVER YOU HAD WORKED IN THE RESTAURANT, YOU MADE NOISE WITH LAUGHING LOUDLY," the letter said. It said her position had been terminated but later said she had quit.

Kollios, a divorced mom of a 7-year-old girl, said she wouldn't have quit because she needs the money. She'll search for another job but isn't optimistic as summer is slow and the economy stinks.

"I'm going to be back to struggling again," said Kollios, who refuses to give her age for fear of discrimination. "If you know anybody who wants a laughing bartender, let me know."

I wasn't there so I cannot comment on whether her laugh was obnoxious or not. Moderation is the key word.

Here's an idea - everyone show up at an agreed upon time, sit down at the bar and quietly order a drink, then start loudly laughing like a bunch of hyenas.

It has been more than five years since I left the Tampa area. There is something inherently wrong with the people there,especially the business owners.

I too, laugh loud and too much - I happen to enjoy what I do or should I say use to do. Also let go for this and being a little too positive and outgoing at work.

Besides, it sounds more like he was just looking for a reason to fire her. I'm going to have my boss put on our marquee that our bartenders are allowed to laugh. Maybe she should come work there, we welcome laughter and personality!

As a bartender it is our job to make the place fun to be at. The first thing you see and the last. If we stood there and didn't laugh or joke with our customers, would anyone other than stuffed shirts want to go? Happy people tip better.

I like some of the people who commented have worked with people who's laughs I found annoying, and I'm sure people found mine annoying as well, but get fired over it? It's absurd! This guy needs to get a life!

Jim, you can not terminate someone for no reason. There are guidelines that you must follow. You can not discriminate against anyone. While this woman's laugh may be annoying, he did not do this properly and may suffer the repercussions.

As a teacher of young adults with special needs, I apprecaite how important proper social behavior can be. Perhaps she was fired for "laughing" or perhaps she was fired for being inappropriate. Hard to tell but the story is certainly slanted.

This is why being a "Right to Work" state is a bad thing Wayne, your incorrect, right to work means you do not have to join the union in order to work. Employment at will is the statue where you or the employer can terminate for no reason.

Does this mean if I visit this "uptight" establishment I am not "allowed" to laugh for fear of being asked to leave? The owner should open a bar in HIS own country where this treatment might be condoned! I say sue his miserable pants off!

Seems the owner is a sourpuss grumpy. Am sure the rest of the people had no idea. However, saying the place is filled with people over 60 means nothing. I race sailboats with people in their 60s. They're not the walking dead but maybe Heo is.

The store owner is in the right here. Loud laughing can be very annoying. She did not respect the owner's request and it looks like she wanted to be "fired" but now regrets it. This is NOT news and is a waste of space. Write about important things!!

This is why being a "Right to Work" state is a bad thing - you can be fired for any reason at all, including nonsense like this. I hope she sues this moron for unfair dismissal, if that even is allowed in Florida (I doubt it).
