Hulk's son won't fight charges

Nick Bollea, the son of famous wrestler Hulk Hogan, is expected to make an open plea in court tomorrow for his role in an August car crash that critically injured his passenger.
Bollea, 17, initially pleaded not guilty to a charge of reckless driving with serious bodily injury. But Assistant State Attorney Scott Rosenwasser said he expects Bollea to offer an open plea to the court during a 1: 30 p.m. pre-trial hearing tomorrow. After that, Circuit Judge Philip Federico will hold a sentencing hearing.
Nick Bollea and his mother, Linda, were seen leaving the office of his attorney, J. Kevin Hayslett, around 5 p.m. Hayslett said he was too busy working on the case to speak to reporters.
"We're going to keep rolling," Hayslett said. "We've got a lot of work to do. No comment."
Lawyers for both sides will be able to call witnesses during the sentencing hearing. Rosenwasser said the mother and father of John Graziano, the former Marine who was injured in the crash, will make statements.
"We're just going to tell the judge everything," Rosenwasser said. "The facts will speak for themselves."
Bollea could receive as little as probation or as much as five years in prison, Rosenwasser said. In an open plea, defendants essentially throw themselves on the mercy of the court.
Clearwater-based criminal defense attorney John Trevena, who is not connected with the case, said Bollea's decision is "somewhat unusual and extremely risky."
He said an open plea is a gamble because there is no negotiation between defense attorneys and prosecutors before going in front of the judge.
"You're throwing yourself on the mercy of the court, hoping the judge gives you a minimal sentence but there's no guarantee. You could get the maximum."
Trevena, who has been following the case, said he doesn't expect leniency from the court. He said Bollea's attorneys have "nothing to lose to try to dismantle the case first (before accepting an open plea)."
Bollea was driving a yellow Toyota Supra on Court Street in Clearwater the night of Aug. 26 when he lost control and smashed into a palm tree. Graziano, who wasn't wearing a seatbelt, was seriously injured and has been in a hospital since the crash. Doctors say he may need lifelong care.
Witnesses to the crash say Bollea was racing with the driver of a silver Viper, Danny Jacobs, who was also charged.
The event is already becoming a media circus. Assistants from Hayslett's Belcher Road office passed out Good Humor ice cream bars to the reporters gathered outside. The offerings: vanilla ice cream covered in chocolate or Creamsicles.

It was a HORRIBLE ACCIDENT. and it should not be looked at amny different than just that. Nick happened to be at the wheel this time but how many times was John at the wheel? I know them personally and have witnessed it the other way around.

They were both in that car,both parties are at falt,It just so happen the one was injured more than the other. They say that nick had alcohol in his system but he cant buy it so I am sure that it was the friend that did.I wish both families the best.

Was booze a factor?If not,#1,seat belts,occupant's responsibility.#2 haven't many of us done stupid things at one time in our lives?Pretty heavy sentence,Be interesting to follow post trial liability awards.(I'm not a wrestling fan)

Federico is one of the nastiest judges on the bench, I think he got paid also. He is just that nasty.

I def don't think that he should get the max at all.Who rides in a car without their seatbelt anyway especailly if any sort of racing is involved, it's all just pure stupidity on his part.He chose not to wear it knowing what could happen!

Teenagers think they're indestructible, and when they're parents have money and fame they think they are untouchable. Big mistake, horrible accident, but still just an accident!! If he wasn't Hulk Hogan's son we would never hear a word about it.

There are some extremely harsh, judgemental comments posted here. Bottom line, both parties are at fault. Nick's punishment will be lifelong. This will follow him & his family forever. He deserves some mercy.

Hey Gyspy and J, are you both for real. I guess you have never been 17. Accidents do happpen, even though people and courts don't think so. This was Nicks best friend, 2 guys out having a good time. I don't think $$ has to do with anything. Sad day

Age does not matter. If you do the crime you do the time. (if you do not wear your seatbelt that is just as bad as speeding. the law says you need to wear seatbelts.)

Nick's punishment was sufficent. John is also at fault for not wearing his seat belt.Famous or not it should not matter.miltary also should not exclude anyone from being guilty.John is guilty. We all need to have seat belts on no matter what.

Another celebrity kid getting off. Why didnt the Hulk take his do rag off in court? Just another perk the judge gave them. If I wore a baseball cap in court,the Judge would hold me in contempt. You also.What a joke.

FYI, the seat belt argument doesn't fly because Nick spun the car around before impact. They hit the tree with the rear end causing both passengers to be forced backwards IN TO their seats, snapping John's neck on the headrest posts. Now shush it

17 year olds make poor judgements.Its who they are.Parents are supposed to let kids learn life's lessons.Sometimes its too easy to save kids from themselves.This time Nick learns the(not too)hard way.

He should be held accountable for his action and also the parents since he is a minor. our 13 year old son was killed by the same kind of diver. We pay everyday for his actions. He paid a fine for running a red light. GREAT JUSTICE SYSTEM.

It was an accident! I am sure if John felt unsafe, he wouldn't have put himself in that situation. They are all teenagers, and they made a mistake, not just Nick! However, just because he's a celebrity, people want him lynched for a mistake.

I wonder how many of you wanting to give him the max ever drove stupid at 17? There are a lot of stones being thrown from people who live in glass house. He deserves punishment, but no the max. The Marine knew what was happening and choice to get in.

A 23y/o Marine hanging with a 17 y/o. Ya think if Nick was poor that would happen? Who used who? Adult marine with no seat belt, while a juvenile drives. Duh. Leave his parents out and just think for a change. Probation is proper.

Regardless what happens, The kid driving the car did not intentionally mean to do harm to his passenger. As a teensger I was involved in an accident as a passenger, and was injured. I was up for the JOYRIDE and encouraged the driver FASTER FASTER

I think it is Graziano's fault that he wasn't wearing a seatbelt...accidents happen and somehow in my mind, I'm sure that Graziano was there saying "Go, go man...beat him". My first instinct would have been to put on my seatbelt. Idiot.

this is so ridiculous. Why isn't there an outcry on every other bad driver out there? Graziano is in the hospital because he chose to ride with nick. sorry, but all kids make bad decisions, what if it was your son?

Does anyone ever accept responsibilty for their actions anymore? As a former probation officer, this case speaks for itself. The driver deserves jail time. How hard is that to understand? I only wished the passenger wore his seat belt. God Bless
