Sheriff's official charged with DUI — 10 days later

BROOKSVILLE — A top official at the Hernando County Sheriff's Office was arrested Monday on a charge of driving drunk — 10 days after witnesses say they saw her crash her truck and act intoxicated at the crash scene.

Emily Vernon, the agency's finance director, faces a misdemeanor charge of driving under the influence causing property damage. She could receive up to a year in county jail.

She was released on a standard $500 bail and will return to work for the time being.

Just before midnight on July 12, witnesses said Vernon swerved across Lake Lindsey Road and hit a road sign before skidding to a stop near the intersection with Daly Road near Istachatta. Several drivers followed Vernon and called 911 to report a reckless driver who they said had forced several vehicles off the road before hitting the sign.

All the evidence at the scene indicated Vernon, 39, was inebriated — including her erratic behavior, witness statements and alcohol found inside her truck — but deputies determined they could not make an arrest because no witnesses saw her behind the wheel.

The State Attorney's Office decided to press charges after four eyewitnesses came forward July 15 saying they saw her driving.

The new witnesses, who were all riding the same vehicle, initially stopped at the scene but left before deputies arrived.

A deputy said Vernon had the faint odor of alcohol on her breath and body and seemed "overly relaxed." Investigators found an empty wine carafe in the passenger seat of the 2004 Chevy truck and a plastic bottle with a half-inch of a pinkish liquid that smelled like alcohol, according to the report.

Assistant State Attorney Rob Lewis said even without the new witnesses, deputies could have made an arrest that night.

"According to the case law, you can use circumstantial evidence to put someone behind the wheel," Lewis said.

"Hindsight being 20/20, could a valid arrest be made? Yes. But I'm not going to second-guess a roadside cop."

Lewis also said he advises deputies to "err on the side of caution," telling them a bad arrest negates the case.

Still, by not initiating an investigation at the scene, prosecutors will have a tough time proving the case without any sobriety tests or breath analysis.

In his first comments about the arrest, Sheriff Richard Nugent acknowledged in an interview Monday that an immediate arrest was possible but said he supports the decision deputies and supervisors made on the scene.

"The deputy on the scene, if you know her, she would arrest her own grandmother if she knew she had a case," Nugent said. "The problem is you have to place the driver in control of the vehicle.

"Could they have made an arrest? Of course," he continued. "Would the charge have been dropped? Of course, it would be."

As for the perception that Vernon was treated differently because she is an agency employee and former county employee, Nugent rejected that notion.

"People who'd say they would have been arrested — I know that's not true, and you're not going to change their mind," he said.

The sheriff told about Vernon's continued bouts with cancer.

She beat it six years ago, but it recently returned and she endured another round of intensive chemotherapy, he said, providing few details.

"Folks make bad mistakes," he said, "but obviously there's something going on, too."

Is smoking a much more serious crime because it is dept. policy or drunk driving because it is against state statutes. So Nugent's law is above state law????

Nugent,your the boss, the buck stops with you! Make it right. You can't have it both ways. Rehire the dispatcher you fired, give her a warning about smoking, let the DUI charge stand as she was over the limit.Thats the right thing 2 do to keep ur job

Thank goodness Florida passed that handy new law allowing guns just about everywhere. Good call, Florida. This way Emily can not only get all drunk and angry behind the wheel, she can ferret out all those pesky illegals picking strawberries because in Florida you can get all drunk and be assured your second ammendment rights. Because we're Americans, dammit!!!

10 days later come on. Sounds like a political move due to the heat coming down. If she was wrong it should of been dealt with than not 10 days later.

Geez, no one mentioned that she is "the agency's Finance Director"? Can you imagine how much dirt she has on every cop in that Cabal? No way she'll do any time or pay any fine.

The lady did wrong, why are we putting her picture in the paper and basically nailing her to the cross? She was not a deputy, she is an employee at the S.O. she just finished battling cancer for God's sake, I think the arrest was bad enough for now.

Chad - you hit the nail on the head. If the public hadn't spoken so loudly, she wouldn't have been arrested. Dont worry Peyton will get her off and get her records expunged! No harm no foul.

The arrest was just for show. It cant be proven in court and she will get the charges dropped because they can't prove the case beyond the shadow of a doubt. It's all about making the votes happy. He must think we are all stupid.

She should've taken 5th amendment-not fifth of booze. Never talk to a cop-even if you are one. Her incriminating big mouth blabbing she was drinking is going to convict her. It's her word against everyone that read her comments or saw story on TV.

excuses, excuses,excuses. Nugent you need to stop. You know this is wrong. all of us have had some one in our families with cancer but that doesnt give them the right to drive dunk. Your people just did a cover up. Maybe its time for you to leave.

HIPAA is the Health Care providers confidentially agreement, meaning that a doctor/dentist/hospital will not make the files they have confidential access to, public.

Thank God there were witnesses - I wonder how many other employees and "friends" of the Sherriff's office have gotten off scott free? I guess the smoker was not liked in the Dept; just an excuse to get rid of her.

Because she beat cancer it's ok to drink and drive? What a crock! She was protected and is still being protected by her buddies on the force. Let's hope the courts don't drop the ball on this one. She isn't above the law no matter what her sob story.

I thought having an open container of alcohol in the vehicle was against the law. The deputy on duty looked the other way because it was one of their own. They should be held accountable. Someone could have died. Nugent don't make excuses.

Pretty soon, Nugent will again be on the radio telling us how concerned he is about drunk driving. He'll have all the details about this year's roadblocks and their merit. Driving and drinking are dangerous, except when it's his employee.

People, on any given day thousands of people throughout the nation get off on "technicalities". This is a system wide problem. I think the OJ Simpson case was more cut and dry that this one and look what happened.

Funny what the sheriffs dept gets away with. One cop destroys a dept car and dies drunk, 12 ram cars all over in a redicioulous chase and now this, plus his Human Resources Dir. When do the police get called to follow the same laws they enforce?

I can see it now open shut with a LAWSUIT! HERE GOES OUR TAXES FOLKS!She should've been arrested the night in question or given the sobriety test! The faint alcohol smell admitted playing w/ipod and water bottle with ALCOHOL in it! SIGNS? YEAH!

Nuggent is correct there is more going on, however the TRUTH is cancer had nothing to do with this story. Stop finding EXCUSSES for reckless behavior.

I am sure that he is not aware of HIPPA law, but obtained her permission first. Let's not forget about the dispatcher smoking, a much more serious infraction and dismissed immediately than driving drunk/open container in vehicle, and not suspended??

That excuse didn't hold up when I had cancer and an arrest was made. Come one Nugent, you can do better than that. You constantly defend your erroneous deputies and employees. Start working for us, the citizens who pay all of your wages.
