New charges filed against man shot by U.S. marshal

TAMPA — David Christopher Sills, the man shot two weeks ago by a deputy U.S. marshal, has been charged with obstructing or opposing an officer, court records show.

Sills, 26, was shot Oct. 16 by a marshal serving a drug trafficking warrant issued by the Tampa police.

The new charges against Sills offered a few fresh details of what happened that day at the Club at Hidden Rivers Condominiums.

According to a criminal arrest affidavit authored by Tampa police Officer Michael D. Cooper, Sills was approached at 11:30 a.m. by deputies wearing full insignia raid vests.

Sills ignored commands to stop and fled into a wooded area, the police report says.

"Due to the defendant's actions (resistance) he suffered a single gunshot wound," it reads. "The defendant was also Tased … during the course of the arrest."

Sills said the charges are unfounded. "I think they're trying to justify what they did to me," Sills said in a phone call from jail Tuesday.

He is charged with one felony count of obstructing or opposing an officer with violence and four misdemeanor counts of obstructing or opposing an officer without violence.

The arrest report does not detail the form of violence Sills is accused of using against law enforcement. Nor does it give any detail about why an officer deployed a Taser stun gun on him after he'd already been shot. Marks on Sill's body show where a bullet entered his back and exited through his right shoulder.

He was treated at St. Joseph's Hospital immediately following the incident.

The U.S. Marshal Service has not released details about the shooting. The Florida Department of Law Enforcement is still investigating.

Sills is scheduled to be sentenced in connection with the original drug charge on Friday. Police say he sold 33.5 grams of cocaine to an undercover officer for $1,100 in November.

Sills says he entered a guilty plea to that charge on the advice of his attorney, but now believes it was bad counsel.
