A Hillsborough County jury has ordered USAA to pay $1.7 million to Jim Favata, a 27-year veteran firefighter from Tampa. Favata’s leg was seriously injured when a ’94 Cadillac struck his motorcycle while traveling north on Route 579 in July of 2008.

October 25, 2010 – TAMPA, FL – A Hillsborough County jury has ordered USAA to pay $1.7 million to Jim Favata, a 27-year veteran firefighter from Tampa. Favata’s leg was seriously injured when a ’94 Cadillac struck his motorcycle while traveling north on Route 579 in July of 2008.
Mr. Favata’s right leg was only saved by a heroic team of Tampa General Hospital surgeons who performed a series of nine surgeries to save the limb.
USAA attempted to deny Favata full insurance money because he was riding the motorcycle with his dog, a 20 lb. Jack Russell terrier who was unhurt in the accident. The insurance company claimed the dog caused a distraction contributing to the accident. The jury disagreed and placed 85% of the blame on the Cadillac driver which, by operation of law, reduced the total damages from $2.1 million to an award of $1.7 million.
"We proved the driver of the Cadillac was mostly to blame, not my client," said attorney Anthony T. Martino of Tampa-based Clark & Martino P.A., who successfully represented Favata with his son and associate attorney Anthony (Nino) Martino.
