Driver is charged in fatal crash

Police have accused a 25-year-old Tampa man of being intoxicated when he ran a red light and caused a fatal accident last month, according to police reports. Luis Augustus Dixon, 25, of 13519-C Orange Sunset Drive, was charged Tuesday with DUI-manslaughter in connection with the Jan. 19 death of Jan R. Ricks, 49, of Ruskin.

Ricks was driving a pickup truck through the intersection of W Kennedy Boulevard and N Dale Mabry Highway when he was struck by a 1987 Mitsubishi driven by Dixon. The accident happened at 2:30 a.m. Dixon suffered cuts and bruises and was taken to a hospital. Tampa police detectives later subpoenaed hospital records and learned that Dixon had a blood-alcohol content of 0.09. Under Florida law, a person is presumed impaired at 0.10. Blood-alcohol tests, however, are not the only evidence used to charge a person with drunken driving.

Dixon's friend, Eric Powery of Tampa, also told investigators that the two were drinking beer at a lounge 30 minutes before the accident.
