Tarpon settles lawsuit over force

The city has settled a 2{-year-old federal lawsuit with a handicapped man who claimed police used unnecessary force against him while searching his home for drugs.

David E. Stewart, 49, will get an $8,000 cash settlement from the city, said Christa Collins, an attorney who has represented the city.

The city will not fight Stewart's accusations in a trial and agreed to the dollar amount to avoid legal costs that would amount to about twice the settlement, Collins said at a City Commission meeting Tuesday night.

The settlement, Collins said, is not an admission of misconduct by the city or its officers.

Stewart's attorney, John Shahan, said Wednesday that Stewart is satisfied with the settlement.

"We believe we would have prevailed if it had gone to trial," Shahan said.
