Despite a jury acquittal, evidence shows that a man accused of burglary and rape did the crimes and thereby violated his probation, a judge ruled Friday.
Christopher Hiatt, 24, was acquitted by a jury on Dec. 17. But Circuit Judge Lynn Gerald Jr. told him that "the greater weight of the evidence" shows he did indeed commit the burglary and rape of a Lehigh Acres dance instructor.
Hiatt, on probation on burglary charges, faces up to five years in prison minus the roughly 18 months he spent behind bars awaiting trial. Sentencing was set for March 2.
