The 5th District Court of Appeal has granted a 21-year-old Brooksville man a new sentencing hearing, citing a judge's error in its ruling released Friday. In May 2007, Sheldon Rashad Redding was convicted by a jury on five charges, including possession of a firearm by a felon. Circuit Judge Stephen Rushing gave him a mandatory three-year prison sentence on the weapons charge. But the three-judge appellate panel found the mandatory provision doesn't apply because prosecutors never presented evidence that Redding carried the firearm. The appellate ruling does not change the guilty verdict.
