A federal judge will not dismiss a Title IX lawsuit filed against Florida State University by the woman who accused Jameis Winston of rape.
U.S. District Court Judge Mark E. Walker denied a motion filed by FSU in March to throw out Erica Kinsman's lawsuit against the school. Kinsman, a Zephyrhills native, has alleged that FSU failed to follow the gender-equity law by showing deliberate indifference with its "clearly unreasonable response" after she accused Winston of rape in December 2012. She sued FSU in January.
FSU has denied wrongdoing. But Walker ruled that Kinsman's complaint has enough merit to go to trial.
"Viewed in the light most favorable to Ms. Kinsman, the complaint plausibly alleges deliberate indifference during this period that effectively denied her the ability to attend FSU," Walker wrote in Wednesday's decision.
A jury trial in Tallahassee is scheduled for July.
Wednesday's ruling has no bearing on Kinsman's separate, civil lawsuit against Winston, now the Bucs' starting quarterback. A trial in that case is scheduled to begin in May 2017.
