Man shot in Davis Islands case now accused of raping Tinder date

TAMPA — Andrew Tyler Noll made headlines five years ago when his ex-lover shot him at her home. She told police he was an intruder. He claimed he was an invited guest.

No charges were filed.

Now, the 28-year-old Noll faces new allegations. He was arrested last week on charges including sexual battery after a woman he met on the dating app Tinder accused him of forcing her to have sex at his home before she managed to escape and get to a police station.

In the 2014 case, Mishay Simpson shot Noll as he stood at the bedroom door of the Davis Islands home where she lived with her daughter and the man who was her husband at the time, semiprofessional golfer Rhett Simpson. Days earlier, Mishay Simpson had sought an injunction for protection from Noll, accusing him of stalking her.

As Tampa police investigated, it was revealed that Noll had been accused of aggressive behavior toward women in three earlier cases — one alleging sexual assault and the other stalking. There were no criminal charges filed, but in one case a judge granted an injunction for protection against Noll.

Police found evidence that Noll and Mishay Simpson had indeed been lovers, including sexual messages they exchanged. Neither of them was charged with a crime in the shooting incident, but Noll took steps to sue Mishay Simpson for medical costs and damages.

The lawsuit remains unresolved.

An police report gives this account of Noll’s recent arrest:

Noll met a woman Oct. 15 through Tinder and they exchanged messages and phone numbers. After midnight on Oct. 16, Noll called her. They talked about meeting later that day, spending time together, going to a dog park.

He gave her the address of his home in Tampa’s West Riverfront neighborhood and she came over about 2 p.m. He let her inside and locked the door, the report states. He led her to a bedroom and started to kiss her but she said “she doesn’t like to get to know people this way,” the report said.

The woman struggled to resist Noll’s advances but he grabbed her cell phone and pulled out a set of zip ties. She managed to grab them away and he held her in a choke-hold. She slipped one of her keys between her fingers and threatened to stab him.

Noll told her “it would be worse for her if she did,” the report said.

She negotiated, asking whether he would stop if she quit struggling. He said he would, but then he sexually assaulted her, the report said.

The woman came up with a ruse to escape, asking Noll if he’d like to get something to eat. He agreed. She put her clothes on, grabbed her belongings and the zip ties, and headed for the door. She had trouble getting it open because the doorknob lock was covered with clear tape, the report said.

After Noll opened it, she headed to her car and drove to the police department.

Detectives later monitored a phone call the woman placed to Noll. He made statements that corroborate the woman’s account, police said, and was arrested on charges of sexual battery, false imprisonment, and tampering with a witness.
